END USER LICENSE AGREEMENT
Last updated: 5 November 2026.
1. Parties and scope
This End User License Agreement (EULA) covers Wycena Pro, its updates and related content and services (the “App”). The Licensor is MAtechnologies sp. z o. o., ul. Walowa 14c, 51-523 Wrocław, Poland. This agreement is solely between you and the Licensor, not Apple or Google. The App is licensed, not sold.
Read this EULA before accepting it. If you disagree, do not accept it or use the App. This agreement does not replace the information for a particular purchase or restrict rights under mandatory law or binding store rules.
2. Limited license
The Licensor grants a nonexclusive, nontransferable license to use the App for its intended purpose on devices you own or control, within the features purchased or made available free of charge. This license does not permit offering the App as your own service or reselling its content. Updates are covered by this EULA unless supplied under a separate agreement.
The App Store version may be used on Apple-branded products under Apple’s usage rules, including applicable Family Sharing and volume-purchase rights. For Google Play, rights to use, reinstall and share the product with family under binding Google Play rules remain intact. This EULA does not override those rights.
3. Copyright and prohibited use
Rights in the code, original text, compilations, database, artwork, marks and other protected elements belong to the Licensor or the respective rights holders. All rights not expressly granted are reserved. No intellectual property ownership or trademark rights are transferred. Public and third-party materials remain subject to their respective rights.
Without authorization you must not copy, publish, sell, rent, sublicense, distribute or create adaptations of protected App elements; extract or reuse databases in bulk; remove ownership notices; bypass payments, limits or security measures; or interfere with services. Decompilation and reverse engineering are prohibited except where permitted by law or open-source component licenses. These restrictions do not exclude statutory exceptions or permitted uses. The Licensor may pursue legally available remedies for infringement.
4. Content and no guaranteed outcome
App content is general information, not individualized legal, professional or other expert advice. The App does not guarantee any particular estimate, acceptance of a quotation, conclusion of a contract or financial benefit. Independently verify information relevant to your decisions. This does not override expressly agreed App features or statutory conformity obligations.
5. “As is” and warranty disclaimer
To the fullest extent permitted by law, the App is provided “AS IS” and “AS AVAILABLE”. The Licensor offers no voluntary warranty and disclaims all excludable express, implied and statutory warranties, including merchantability, fitness for a particular purpose and noninfringement. To the same extent, the Licensor does not guarantee error-free or fully current content, uninterrupted access, compatibility with every device or correction of every defect.
These exclusions do not affect mandatory digital-content and digital-service conformity requirements, required updates, statutory remedies or other nonwaivable rights. Support communications do not create an additional warranty unless expressly and validly agreed.
6. Limitation of liability
To the fullest extent permitted by law, the Licensor excludes liability for indirect or consequential loss, lost profits, revenue or business opportunities, business interruption and data loss arising from use of, or inability to use, the App, regardless of the legal basis of the claim or prior notice of possible loss.
Only for users who are neither consumers nor persons entitled to statutory consumer protection, and where lawful, the Licensor’s aggregate liability relating to the App is limited to the amounts actually paid to the Licensor for the App during the 12 months before the event giving rise to the claim.
Nothing excludes or limits liability for intentional misconduct, fraud, death or personal injury where exclusion is prohibited, or any other liability that cannot lawfully be excluded. These limits do not impair mandatory consumer rights or remedies under store rules. Where a limitation is impermissible, the liability required by law applies.
7. Purchases, subscriptions and refunds
Paid features, price, billing period and any automatic renewal are disclosed before purchase. If a purchase is a renewable subscription, manage renewal and cancellation under the payment platform’s rules. Deleting the App does not itself cancel a subscription. Price changes apply to future periods and require any notices or consent mandated by law and store rules.
Billing and refunds follow the applicable App Store, Google Play or other payment platform rules and applicable law. This EULA imposes no blanket no-refund rule and does not exclude statutory withdrawal rights. A digital-content withdrawal right is lost only when all legal conditions, including required consent, disclosures and confirmations, have been met.
8. Maintenance, changes and external services
The Licensor provides support and updates required by law or expressly agreed. There is no commitment to develop extra features or support every device and operating-system version indefinitely. You are responsible for your device, connection and installation of properly supplied updates, subject to your statutory rights.
For justified technical, security, abuse-prevention, legal-compliance or external-platform compatibility reasons, the Licensor may change features or temporarily restrict access. Changes beyond maintaining conformity will comply with law, impose no extra cost on consumers and include required durable-medium notices and termination rights where applicable. Discontinuation does not erase obligations to existing purchasers, including refund obligations.
Third-party services, links and components are subject to their applicable terms, which you must observe. To the extent permitted by law, the Licensor is not responsible for matters outside its control; this does not exclude responsibility for its own performance or rights under open-source licenses.
9. Breach and termination
You may stop using the App by deleting it and separately cancelling any subscription. For a material EULA breach, the Licensor may proportionately restrict access or terminate the license, providing legally required notice and an opportunity to remedy the breach. Immediate restrictions for fraud, unlawful access or security threats are permitted only within legal limits.
After valid license termination, cease the covered use and delete copies, subject to rights required by law and store rules. Intellectual property, liability and dispute provisions survive as appropriate. Termination does not remove refunds or other mandatory remedies due to you.
10. App Store-specific terms
For the Apple version, the Licensor, not Apple, is responsible for the App, content, maintenance, support and product, regulatory, privacy and consumer claims. Apple owes no maintenance or support. If the App fails an applicable warranty, notify Apple for a purchase-price refund. Where lawful, Apple owes no further warranty remedy; remaining related claims are the Licensor’s responsibility.
The Licensor, not Apple, handles investigation, defense, settlement and discharge of third-party intellectual-property claims concerning the App or its use. Apple and its subsidiaries are beneficiaries entitled to enforce this EULA upon your acceptance. Apple’s usage rules override conflicting EULA restrictions.
11. Privacy and legal compliance
Data processing is described in the Wycena Pro Privacy Policy linked below. This EULA neither replaces that policy nor provides blanket consent to processing. Comply with applicable laws, including export controls and sanctions. For the Apple version, you represent that you are not in a country under a US embargo or designated by the US as supporting terrorism and are not on a US prohibited or restricted-party list.
12. Governing law, EULA changes and final provisions
Polish law applies without depriving consumers of mandatory protection under the law of their habitual residence. Court jurisdiction is determined by applicable law. You do not waive any right to bring proceedings before a competent court.
This EULA may change to reflect legal changes, store requirements or justified App changes described above. Changes are not retroactive; required notice and consent will be provided. Continued use does not replace consent where legally required. An unenforceable provision does not affect the remainder if the agreement can continue without it. Failure to enforce a right does not waive it.
13. Estimates, price lists and calculations
Wycena Pro is a supporting tool for preparing service and material estimates, cost calculations and quotations. It is not an appraisal, accounting, tax-advisory, design or inspection service. Outputs are not certified valuations, expert opinions, design documentation or confirmation that work complies with law, standards or technical requirements.
Price lists, templates and default values are starting points for an individual calculation, not assurances of market prices, a complete scope of work or current tax rates. Before relying on an output, verify quantities, units, measurements, prices, VAT, currency, discounts, markup and margin, overheads, transport, travel and rounding. Margin and markup are not interchangeable. Estimated profit is not guaranteed actual profit or an accounting result reflecting every liability.
Time, distance, travel-cost and work estimates depend on inputs and actual conditions. The Licensor does not guarantee material availability, contractor rates, profitability, completion dates or winning a contract. These qualifications do not exclude agreed functional correctness or mandatory App conformity obligations.
14. Input verification and user decisions
You determine the scope and conditions of your own quotation and are responsible for the accuracy, completeness and lawfulness of your inputs, measurements, assumptions, prices and client data. Before sending, signing or relying on an estimate, check all items, totals, taxes, parties, dates, exclusions and commercial terms; consult an appropriate professional where specialist knowledge is needed.
The Licensor is not a party to your contracts with clients, contractors or suppliers, does not approve quotations and does not assume obligations to perform work, pay or warrant that work. A document’s legal effect depends on its content, circumstances and applicable law, not merely on generation in the App.
To the extent permitted by law and subject to section 6, the Licensor is not liable for consequences of your inaccurate or incomplete inputs, unverified assumptions, independent document changes or commercial decisions, including underestimated costs, underpricing, lost margins, client disputes, contractual penalties and tax settlements, to the extent caused by those circumstances. This does not exclude liability for the Licensor’s own acts or omissions where it cannot validly be excluded.
15. Documents, client data and rights in materials
Within the App’s intended purpose, you may create, export, print and send your own estimates and quotations to clients, including commercially. Section 3 does not prohibit this ordinary use of generated documents. This does not authorize reselling the App, its templates or content database as a separate product. You retain rights in your own materials; this EULA does not transfer them to the Licensor.
You must have rights to logos, photographs, descriptions and other materials you use, and an appropriate legal basis to process and disclose client data. Do not include data unnecessary for the document’s purpose. Before sending or sharing a document, check the recipient, personal data and confidential information. Generating a PDF does not itself verify, sign, deliver or obtain the recipient’s acceptance of a quotation.
Only for users without statutory consumer protection, and where lawful, you cover amounts finally awarded by a court and reasonable documented defense costs for third-party claims against the Licensor to the extent caused by your culpable unlawful use of third-party materials or data in the App. This excludes consequences of the Licensor’s conduct; the Licensor must promptly notify you of the claim and allow your participation in its defense. A settlement imposing obligations on you requires your prior consent. Section 6 exceptions and limitations remain applicable.
16. Storage, backups and synchronization
Maintain independent copies of important estimates, documents, price lists and client data, and check exports and backup restoration, particularly before an update, device change, restoration, reset or App deletion. The App does not replace legally required document archiving.
Optional iCloud or Google Drive backups and synchronization depend on your account, available storage, connectivity, permissions and the provider’s rules. The Licensor does not control these services or guarantee uninterrupted operation, version-conflict resolution or recovery of deleted or overwritten data. Synchronization is not a substitute for an independent backup. Check the backup date and correct version before restoring.
Exclusions concerning data loss, interruptions and external services apply only within sections 5, 6 and 8. They do not remove the Licensor’s obligations concerning data protection, security, agreed feature performance or statutory conformity. The Wycena Pro Privacy Policy describes data processing and backup arrangements.
